Terms of Service

These Terms of Service ("Terms") apply to ImgAI at https://imgai.ai (the "Service"). Effective 15 September 2026.

1. Introduction and acceptance

Welcome to ImgAI ("ImgAI", "we", "us", or "our").

These Terms govern your access to and use of our AI-powered creative platform, including AI image and video generation and related tools, available at https://imgai.ai.

By creating an account, subscribing to any plan, purchasing credits, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood, and agree to be bound by these Terms; (c) agree to our Privacy Policy; and (d) are authorized to enter into this agreement on behalf of yourself or any organization you represent.

If you do not agree to these Terms, do not use the Service. Continued use after an update constitutes acceptance of the revised Terms.

2. Service description

2.1 What we provide

ImgAI provides an AI-powered platform that lets users generate and edit images and videos, manage creations, and use related creative tools. The Service is a digital software-as-a-service (SaaS) product delivered over the internet.

2.2 Nature of the Service

The Service is a digital, intangible product delivered over the internet. You can use it without paying, subject to free quotas. Paid subscription benefits and purchased credits are granted immediately upon confirmed payment. Because those paid portions are delivered immediately, refunds are limited as described in Section 7.

2.3 AI model dependency

The Service uses third-party AI model providers, including Google, OpenAI, and other vendors we integrate from time to time. Performance and availability may be affected by those providers. We will try to communicate significant disruptions in a timely manner. We do not guarantee a particular output quality, and we are not responsible for content generated by third-party models.

3. Account registration and eligibility

3.1 Account creation

Limited free features may be available without an account, subject to quotas. An account with accurate, complete information is required to subscribe, buy credits, keep a credit balance, or use paid features. You are responsible for keeping your login credentials confidential and for all activity under your account.

3.2 Account security

• Notify us immediately of any unauthorized use at support@imgai.ai.
• Do not share your credentials with any third party.
• Keep your billing email address up to date.
• We may delete accounts created through abusive or fraudulent registration, including registrations that use temporary or disposable email addresses, along with associated data.

3.3 Business accounts

If you register on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

4. Plans and credits

We offer paid subscription plans (monthly or yearly) that grant credits each billing cycle, and separately sold credit packs that you can buy at any time. Current plans, credit amounts, and prices are published at https://imgai.ai/pricing. Credits are used to run generations and related paid features. The credit cost of a generation is shown before you confirm it. Failed generations are refunded in credits automatically.

We may change plan features or introduce new plans. Price changes follow Section 5.

5. Billing and payment

5.1 Subscription auto-renewal authorization

When you provide a payment method and subscribe to a paid plan, you expressly authorize ImgAI to charge that payment method the then-current subscription fee on each billing cycle. That authorization remains in effect until you cancel under Section 6.

Your subscription renews automatically at the end of each billing cycle unless you cancel. We will send a reminder before an annual subscription renews.

5.2 Credit pack authorization

Each credit-pack purchase is a one-time transaction. Completing checkout authorizes ImgAI to charge the amount shown at checkout.

5.3 Taxes

Unless stated otherwise, listed prices do not include applicable taxes (including VAT, GST, or sales tax). Where required by law, we will collect and remit those taxes.

5.4 Payment processor

Payment card data is processed exclusively by our PCI-DSS compliant payment processor, Waffo Pancake, and is not stored on our servers.

6. Cancellation

You may cancel a subscription at any time:

• Online (recommended): Settings → Billing → Cancel subscription
• Email: send a cancellation request from your registered email address to support@imgai.ai

Cancellation takes effect at the end of the current billing period. You keep the paid subscription benefits until then. You will not be charged for later cycles. Separately purchased credit packs are not canceled; they remain available under Section 7.4.

7. Refund policy

7.1 Subscription refunds

Because paid subscription benefits are delivered immediately as a digital product, subscription fees are generally non-refundable, except:

• New-subscriber 7-day guarantee: first-time subscribers may request a full refund within 7 days of the first charge if they have used no more than 20% of that plan’s credit quota for the period.
• Duplicate charges caused by a billing error: full refund.
• Verified outages lasting more than 72 hours that are our fault: pro-rata refund or an extension.
• Statutory rights (including any cooling-off period required by applicable law, such as in the EU or UK) are preserved.

Annual subscription fees are not refundable more than 30 days after the first purchase, except where the 7-day guarantee or a statutory right applies.

7.2 Credit-pack refunds

Purchased credits can be refunded while they are unused (we refund the payment). For this assessment we count free credits — including check-in and sign-up grants — as spent first: if your remaining balance is still at least the number of credits you bought, that purchase is treated as untouched and refundable. Contact support and we will review it. Duplicate charges caused by a billing error are refunded in full. Consumed purchased credits are not refundable. Statutory cooling-off rights for first-time buyers, where they apply, end once those purchased credits are first used.

7.3 Subscription credit rollover

Subscription credits roll over from one billing cycle to the next while the subscription remains active. They do not expire on their own during a paid subscription.

7.4 Credits after cancellation

Credits already in your account — including unused subscription credits and separately purchased packs — remain available after cancellation and do not expire. Canceling does not delete unused credits.

7.5 How to request a refund

Email support@imgai.ai with your account email, transaction ID, and reason. We will acknowledge within 2 business days and process eligible refunds within 5–10 business days to the original payment method.

7.6 Non-refundable items

• Used subscription periods, except as in Section 7.1.
• Consumed credits, except as in Section 7.2.
• Accounts closed for violating these Terms, Section 10, or the Acceptable Use Policy.

8. Billing disputes

If you think a charge is wrong, contact support@imgai.ai before disputing it with your bank. We will respond within 2 business days and resolve confirmed billing errors within 5 business days.

9. AI output and intellectual property

9.1 Ownership of outputs

Subject to these Terms, AI-generated content produced from your inputs ("Outputs") is owned by you. You may use Outputs for any lawful purpose consistent with Section 10, including personal and commercial use, subject to the usage terms of the underlying model provider.

9.2 Input license

By submitting content to the Service ("Inputs"), you grant ImgAI a limited, non-exclusive license to process those Inputs solely to deliver the Service. We do not use your Inputs to train AI models without your explicit consent.

9.3 Third-party models

Outputs may be influenced by third-party model providers named in Section 2.3. We do not warrant specific output quality and are not liable for content those models generate.

9.4 Accuracy

AI-generated content may contain errors. You are responsible for reviewing and verifying Outputs before relying on them.

10. Acceptable use

The full content standards, moderation, reporting, and enforcement rules are in the Acceptable Use Policy. This section is a summary; that Policy controls on content rules.

10.1 Permitted use

You may use the Service only for lawful purposes consistent with these Terms, including personal creative work and commercial creative work.

10.2 Prohibited use

You agree not to use the Service to:

• Generate illegal, defamatory, harassing, or fraudulent content.
• Generate, distribute, or assist in producing deepfakes — including AI-synthesized audio, video, or images that impersonate a real person or are intended to mislead viewers about origin or authenticity.
• Generate sexualized content involving minors or otherwise violate child-protection laws.
• Create malware, phishing content, or tools for cyberattacks.
• Infringe any third party’s intellectual property or privacy rights.
• Bypass or interfere with the Service’s security features.
• Resell or sublicense access without our prior written approval.
• Violate any applicable law, regulation, or card-network rule.

10.3 AI-specific prohibitions

You also agree not to:

• Use Inputs, Outputs, model responses, or any derivative data to train, fine-tune, benchmark, distill, or otherwise develop an AI or machine-learning model that competes with the Service or ImgAI.
• Systematically scrape, extract, or harvest model outputs at scale for any purpose other than your own authorized use.
• Present AI-generated content as the work of a licensed professional (such as a doctor, lawyer, or financial adviser) in a setting where that could cause harm.

11. Data, privacy, and security

Your use of the Service is subject to our Privacy Policy. Payment card data is processed exclusively by our PCI-DSS compliant payment processor, Waffo Pancake, and is not stored on our servers. Account deletion takes effect immediately and cannot be undone; we then delete or anonymize account and creative data, except records we must keep by law.

12. Disclaimers and limitation of liability

12.1 Disclaimer

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or accuracy of AI outputs.

12.2 AI-generated content disclaimer

AI outputs may be inaccurate, incomplete, or out of date. Do not use them as legal, medical, financial, or other professional advice. Verify with a qualified professional before acting on AI content.

12.3 Limitation of liability

To the maximum extent permitted by law, ImgAI is not liable for any indirect, incidental, consequential, or punitive damages. Our total liability is limited to the amount you paid us in the 12 months before the claim.

13. Term and termination

These Terms apply for as long as you use the Service. We may suspend or terminate your account if you materially breach these Terms, if we suspect fraud, or if the law requires it. If we terminate for a reason other than your breach, we will refund prepaid unused amounts on a pro-rata basis. You may request account deletion at any time by emailing support@imgai.ai. Deletion takes effect immediately and cannot be undone.

14. Governing law and dispute resolution

Before starting a formal proceeding, email support@imgai.ai and try to resolve the dispute informally.

15. General provisions

We may update these Terms at any time. Material changes will be notified by email at least 14 days before they take effect. Continued use after that date is acceptance. If any provision is held invalid, the rest remain in force. These Terms, the Privacy Policy, and the Acceptable Use Policy are the entire agreement between you and ImgAI regarding the Service.
